Burst Fracture L1-S1 Confidential Settlement

Miraldi and Barrett recently obtained a substantial confidential settlement on behalf of a 24 year old single man who sustained serious injuries in an industrial accident that occurred in Lorain, Ohio. The man fell 20 feet through an unguarded opening in a floor where he was working. The defendants claimed the worker was warned about the presence of the opening in the floor and denied responsibility. Miraldi and Barrett argued that a guard around the opening was required, and a verbal warning was not a sufficient precaution to prevent injury. After two years of litigation the parties agreed to submit the case to a private mediation proceeding which resulted in the agreed settlement.
