Electrocution Injury and Death -- $3,350,000 Verdict
Client's husband was hired to provide one night of labor for a crew demolishing the interior of a store prior to its remodeling. The general contractor failed to properly de-energize the electrical lines. The man had no training and was not provided with insulated pliers. When he attempted to cut an electrical line, he was electrocuted. The man survived in a coma for thirty days before dying. The defense argued that the man was negligent in using uninsulated pliers and failing to determine whether the line was dead before touching it. Miraldi and Barrett, through expert testimony, demonstrated that the the proper way to de-energize the electrical system was to disconnect the wires and lock the box. In this case, the general contractor had simply turned off the circuits that were later turned back on. After a one week trial, the jury returned a verdict in favor of the man's wife and two minor daughters.
