Failure to diagnose malignant tumor on tongue -- confidential seven figure settlement

Miraldi and Barrett represented the widow of a 53 year old Akron man who died from complications due to squamous cell carcinoma.  The man had complained to his family dentist about a sore on the edge of his tongue.  The dentist referred the man to an oral surgeon who removed the lesion and sent it to a laboratory for evaluation.  The pathologist reported that the lesion was pre-cancerous, but that not all of the lesion had been removed.  The pathologist recommended that the patient be followed very closely.  Instead, the patient was told that the lesion was not cancerous and that he did not need to be concerned.  A year later the patient was referred back to the oral surgeon by his family dentist because the sore had returned.  The oral surgeon told him to put Vitamin E on the sore.  When this did not help, the man returned to the oral surgeon, the lesion was biopsied and now the lesion was cancerous.  The cancer had spread to the lymph nodes and the patient died.  The oral surgeon and dentist settled before trial.
