A 48 year old Elyria man died in the hospital two days after a vascular surgeon had performed surgery to improve circulation in a leg. The cause of death was a blood clot that traveled from his leg to his heart. Miraldi and Barrett proved that this patient had a risk for developing blood clots in his legs. The surgeon under the standard of care was required to install a filter, commonly called a "greenfield filter" in order to prevent blood clots from traveling to the heart or lungs. After suit and before trial, the surgeon's insurance company paid the policy limit to settle the case.
