
A family physician removed several skin moles from a 45 year old woman patient and put them in one vial and sent them to a lab for evaluation. The pathology slides were reported as showing no abnormalities. The woman moved to another state. Several months later she sought the advice of a doctor for a non healing area on her thigh where one of the moles had been removed. She was then diagnosed as terminal with Stage IV malignant melanoma. Review of the original slides showed that one of the moles contained evidence of Stage II malignant melanoma. Ben Barrett proved to the jury that the patient probably would have survived if the first slides had been interpreted properly. The verdict was against the pathology laboratory.
