Homeowner's policy used to cover trustees of fraternal organization - confidential settlements
The client's under-aged teenage son and other teens were served alcoholic beverages at a fraternal club. On their way home, the boy and his friends were killed when their vehicle went out of control and slammed into two other vehicles. The underaged driver was intoxicated. Miraldi and Barrett filed a lawsuit against the fraternal organization that ran the bar for serving underaged patrons. There was no insurance coverage for the bar. Miraldi and Barrett sought insurance coverage from the homeowner policies of the club's trustees and the parent organization of the fraternal organization. Miraldi and Barrett was successful in finding and demonstrating coverage for those responsible for overseeing the club and the parent organization that provided a charter to the club.
