Man standing by tow truck deemed to be occupying it for underinsured motorist coverage -- $797,500 settlement

Client's son whose truck had run out of gas was leaning against the side of a service truck after the service truck had delivered fuel to him and the service truck driver was writing up the bill.  A drunk driver went off the road and struck the client's son, killing him almost instantly.  The drunk driver had minimum insurance coverage and the client's son had no underinsured motorist coverage.  Miraldi and Barrett claimed that the client was entitled to underinsured motorist coverage from the insurance policy for the service truck.  Miraldi and Barrett was able to show that the client had such a connection to the service truck that he was "occupying" it when he was providing information to the driver while the driver was writing up his bill.  The case went to the Ohio Supreme Court and Miraldi and Barrett prevailed against the insurance company.
