Poorly designed roadway -- confidential settlement
The parties responsible for a poorly designed road agreed to settle after extensive investigation, accident reconstruction with highway design experts, and litigation. Miraldi and Barrett was able to establish that an extremely steep and narrowed road at a railroad crossing should have been corrected or turned into a one way street to avoid what happened in this case. The client had been a passenger in a vehicle that crashed into a car coming from the opposite direction. The client's driver had come over this steep hill at the railroad crossing, but was unable to avoid crashing into the approaching car because it was not visible. Funds were set aside to provide for the care, equipment, and modification of the home needed to help care for the paralyzed mother and wife.
