Pothole in parking lot and fractured arm -- $175,000 settlement
A 65 year old North Ridgeville woman was injured when a wheel on her grocery cart dipped into a depression in the parking lot causing it to tip and take the woman with it. Because it was raining at the time, the hole was filled with water and was not readily observable by the woman. The grocery store argued that it did not have notice of the hole and that the woman was hurrying at the time. Miraldi and Barrett was able through its investigation to show that another man had been injured by the same hole a few weeks before. This debunked the grocery store's claim that it was unaware of the hole. The case settled during a break on the first day of trial.
