Q: Can I sue the hospital as well as the doctor?
A: If the health care professional is an employee of the health facility, the facility itself can be sued under the legal doctrine of respondeat superior. However, if the health care professional was acting as an outside contractor, the facility might not be held liable unless it was negligent in granting privileges to the professional.
